Estate administration and probate
The loss of a loved one can be incredibly emotional. We’re here to offer the legal advice that eases the administrative burden.
When we lose someone we care about, it can be very challenging to start focusing on the practical implications of that loss. Grief is complicated and stressful, so we work with our clients in a hands-on way, focusing on being a source of support as much as practical advice.
At Berwins, we will walk you through the process or handle it all from start to finish, depending on which approach best suits your needs. We’ll work to ease some of the pressures and worries that come with estate administration and crucially, ensure that you are protected from being personally liable for debts, legacies or legal action in Court.
Understanding probate
Probate is the legal and financial process associated with the handling of the property and possessions of a person who has died. It involves ensuring that a Will is valid and determining who has the authority to administer an estate.
Once that is established, the process of estate administration involves obtaining grant of probate, identifying the value of the estate, paying any inheritance tax and finalising accounts and personal wishes.
Administration options
There are a number of ways that Berwins supports people dealing with the affairs of someone who has died. You may opt for:
- Full administration – where our expert team handles all issues relating to the estate
- Grant only probate – where Berwins will simply deal with the legal documentation associated with grant of probate
- DIY probate – where you will be responsible for all aspects of estate administration, possibly following an initial meeting with a member of our team, at which high-level detail of the process is discussed
Further information on probate fees can be found below.
The team is excellent, offering a very professional and knowledgeable approach to the issues being faced and delivering them in a no-nonsense fashion.
